These Terms of Use apply when you access nyft.app, create or use a Nyft account, or use a Nyft application or related service. By using Nyft, you agree to these terms. If you do not agree, do not use the service.

App marketplaces and third-party services can apply their own terms in addition to these terms. Nothing here removes rights that cannot be waived under applicable consumer law.

You must be at least 13 years old, meet any higher minimum age required where you live, and be legally able to agree to these terms. If you use Nyft for an organization, you confirm that you have authority to act for it.

Provide accurate account information and keep your Apple or Google sign-in method secure. You are responsible for activity performed through your account and trusted devices. Contact support@nyft.app promptly if you suspect unauthorized access.

You may use Nyft for personal, professional, and other lawful transfers. You may not use Nyft to:

• Transfer content that is unlawful, harmful, deceptive, abusive, or that infringes another person's intellectual property, privacy, or other rights.
• Distribute malware, malicious code, spam, or content intended to compromise another device or account.
• Probe, disrupt, overload, bypass, or interfere with Nyft's security or operation, except where applicable law permits it or Nyft has authorized security testing.
• Impersonate another person, misrepresent your affiliation, or use a device without the owner's permission.
• Resell, scrape, or automate access to Nyft in a way that burdens the service or has not been authorized.

You keep ownership of the files, photos, folders, text, links, and other content you transfer. You confirm that you have the rights and permissions needed to transfer that content.

You are responsible for selecting the correct destination device, reviewing what you send, and maintaining appropriate backups. Nyft cannot recover content deleted from your devices and does not guarantee that every attempted transfer will complete.

Subject to these terms and applicable marketplace rules, Nyft grants you a limited, personal, non-exclusive, non-transferable, and revocable right to install and use the application on devices you own or control.

For Nyft downloaded through an Apple App Store, Apple's Standard End User License Agreement applies unless Nyft provides a custom license agreement through App Store Connect. Apple is not responsible for Nyft's maintenance or support.

Nyft is still rolling out across supported platforms. Features, technical requirements, and availability can change as the service develops. References to planned features or platforms describe current intentions, not a promise that a feature will launch on a particular date.

Nyft may update, suspend, or discontinue part of the service when reasonably necessary for security, maintenance, legal compliance, or product changes. When practical, Nyft will provide notice of a material change that affects your use.

Nyft's software, website, visual design, branding, documentation, and other product materials are owned by Nyft or its licensors and are protected by applicable intellectual property laws. These terms do not transfer ownership of those materials or permit use of Nyft's name, logo, or branding outside ordinary references to the product.

Feedback is welcome. If you send product suggestions, Nyft may use them without restriction or payment, but you are not required to provide feedback.

You may stop using Nyft at any time. To request account deletion, email support@nyft.app from the address associated with your account.

Nyft may limit or suspend access if you materially violate these terms, create a security or legal risk, or misuse the service. When appropriate, Nyft will give you notice and a reasonable opportunity to resolve the issue.

To the fullest extent permitted by law, Nyft is provided on an as-is and as-available basis. Nyft does not promise that the service will always be uninterrupted, error-free, compatible with every device, or able to deliver or recover every transfer.

To the fullest extent permitted by law, Nyft is not responsible for indirect, incidental, special, consequential, or punitive losses arising from use of the service, including loss of data, content, opportunity, or profits. Nothing in these terms excludes liability or consumer rights that cannot lawfully be excluded or limited.

Nyft may revise these terms as the service develops. The date at the top shows the latest revision. Material changes will be posted here before they apply, and additional notice will be provided when required by law.
